These Terms of Service ("Terms") govern your access to and use of the Star Carnet mobile application (the "App"), provided by CWH3 Holdings LLC ("Company," "we," "us," or "our").
By creating an account, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Apple App Store Terms (iOS)
If you downloaded the App from the Apple App Store:
These Terms are between you and the Company, not Apple.
Apple is not responsible for the App or its content and has no obligation to provide maintenance or support services for the App.
You agree to comply with Apple’s usage rules.
You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
2. Eligibility and Account Registration
Eligibility: You must be at least 13 years old to use the App. If you are under the age of majority where you live, you represent that your parent/guardian has reviewed and agreed to these Terms.
Account: Some features require an account. You agree to provide accurate information and keep it updated.
Security: You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.
3. License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
You agree not to:
Use the App unlawfully or in violation of these Terms
Attempt to gain unauthorized access to the App or related systems
Interfere with or disrupt the App (including by scraping, probing, or introducing malware)
Reverse engineer, decompile, or attempt to extract source code, except where prohibited by law
4. User Content
The App may allow you to submit content such as places you have eaten, notes, lists, ratings, photos, and other materials ("User Content").
Ownership: You retain ownership of your User Content.
License to us: You grant the Company a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/technical purposes), display, and distribute your User Content only as needed to operate, provide, and improve the App, and as you direct via in-app settings/sharing actions.
Your responsibility: You represent and warrant that you have the rights to submit User Content and that it does not violate law or third-party rights.
Removal: We may remove or restrict access to User Content if we reasonably believe it violates these Terms, is unlawful, or risks harm.
5. Subscriptions and Purchases (Apple Billing)
The App may offer an optional subscription to unlock additional features ("Subscription").
Billing: Subscriptions are processed by Apple via your Apple ID and the App Store. We do not receive or store your full payment information.
Auto-renewal: Unless you cancel, your Subscription will automatically renew and your Apple ID account will be charged.
Manage/cancel: You can manage or cancel subscriptions in your Apple ID subscription settings.
Trials: If offered, trials convert to paid subscriptions unless canceled before the trial ends, subject to Apple’s rules.
Refunds: Refund requests are handled by Apple under App Store policies.
Ads: The App may display advertisements. We currently intend to use non-personalized ads by default. Advertising providers (such as Google AdMob) may collect device information and advertising identifiers to deliver and measure ads, subject to their policies and your device settings.
Analytics: The App uses analytics tools (such as PostHog) to understand usage patterns and improve the App. Analytics may collect event data, device/app info, and IP address (often used to derive approximate location), subject to provider settings and policies.
8. Intellectual Property
The App and all related intellectual property (excluding User Content) are owned by the Company and its licensors and are protected by law. Except for the license granted in these Terms, no rights are granted to you.
9. Feedback
If you provide suggestions or feedback, you grant us the right to use them without restriction or compensation.
10. Termination
You may stop using the App at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms or for security/maintenance reasons. Upon termination, your license ends.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Company from claims arising out of your use of the App, your User Content, or your violation of these Terms.
14. Changes to the App or Terms
We may update the App and these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, in the App and by updating the effective date). Continued use after changes become effective constitutes acceptance of the updated Terms.
15. Governing Law; Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where your local law requires otherwise. Unless prohibited by applicable law, disputes will be brought in the state or federal courts located in King County, Washington, and you consent to their jurisdiction and venue.
